2.     General Note
Under Article 13 of the Swiss Federal Constitution and the provisions of the Federal Data Protection Act (DPA), every individual has the right to privacy and to protection against the misuse of their personal data.
Swiss Functional Solutions GmbH places great importance on protecting your personal data and strictly complies with the requirements of the Swiss Data Protection Act (DPA).
Below, we explain which personal data we collect, how we process it, and the measures we take to ensure its protection.
Please note that data transmission over the Internet (for example, when communicating by email) may involve security risks. As a result, complete protection of data against access by third parties cannot be guaranteed.

3.     Data Security
We store your personal data in both electronic and physical (paper) form. We apply appropriate technical and organizational measures to protect your data against loss, unauthorized access, misuse, disclosure, alteration, and destruction.
Access to your personal data is limited to authorized individuals who need this data to perform their duties. All employees and contractual partners who have access to personal data are bound by confidentiality obligations and must comply with applicable data protection regulations.
In certain cases, we may need to forward your inquiries or data to affiliated companies or service providers as part of order processing. In these situations, your data will also be handled confidentially and securely.
This website uses SSL/TLS encryption for security purposes and to protect the transmission of confidential information (such as data submitted via contact forms). This encryption ensures that the data you send to us cannot be accessed by third parties. You can identify an encrypted connection by the change in your browser’s address bar from "http://" to "https://" and by the appearance of the lock icon.

4.     Hosting and Domain Management

Our website operates on an integrated technical infrastructure:

Domain management is provided by Hostpoint AG, Neue Jonastrasse 60, 8640 Rapperswil-Jona, Switzerland. Web hosting and website operations are carried out by Wix.com Ltd., 40 Namal Tel Aviv St., Tel Aviv 6350671, Israel ("Wix").

Domain management (DNS) at Hostpoint

We continue to use the DNS servers of Hostpoint AG for the domain in question. In the course of domain registration and administration, personal data (such as name, address, email address, and technical information) may be transmitted to Hostpoint or to the relevant domain registration authorities (e.g., SWITCH or ICANN). This data is processed solely for technical provision, contract fulfillment, and the proper operation of the domain.

This means that technical requests (such as domain name resolution) are handled through Hostpoint’s infrastructure. In this process, technical connection data such as IP addresses and timestamps may be transmitted to Hostpoint and stored in log files to ensure the stability and security of the domain service.

Hostpoint is subject to the Swiss data protection law and is contractually obligated to treat all personal data confidentially and to protect it against unauthorized access.

Data processing is carried out solely for the purpose of providing and maintaining domain and DNS functionality. Further information on how Hostpoint handles personal data can be found here: https://www.hostpoint.ch/en/hostpoint/contact-gtc.html.

Web Hosting at Wix

Our website is hosted on the servers of Wix.com Ltd. Wix stores your data on secure servers protected by firewalls and various physical and electronic security measures. To provide its services, Wix may use servers located in the European Union, the United States, or other countries. As a result, personal data may be transferred to third countries that do not provide an equivalent level of data protection as defined by the Swiss Data Protection Act (DPA).

However, Wix ensures an adequate level of data protection through appropriate contractual and organizational measures, for example, by using the standard contractual clauses of the EU Commission.

For further details on how Wix processes personal data, please refer to the Wix Privacy Policy: https://de.wix.com/about/privacy.

Every data subject has the right to obtain, free of charge, information from the operator of this website as to whether personal data concerning them is being processed. If such processing is taking place, you are entitled to receive a copy of the personal data as well as the following information:

  • the purpose of processing,

  • the categories of personal data being processed,

  • the recipients or categories of recipients to whom the personal data has been or will be disclosed, in particular recipients in third countries or international organizations,

  • where applicable, information on whether personal data has been transferred to a third country or an international organization, as well as the safeguards in place to protect the data.

Upon request, we inform you which personal data we have stored about you, for what purposes it is being processed, and to whom it has been or may be disclosed. If you wish to exercise your right of access, you may contact the responsible office named in this privacy policy at any time, either in writing or by email.

Right to rectification
Every data subject has the right to request the prompt correction of inaccurate personal data concerning them. In addition, data subjects may request the completion of incomplete personal data, taking into account the purpose of the processing, if necessary by providing a supplementary statement.
If you wish to exercise your right to rectification, you may contact the responsible office named in this privacy policy at any time, either in writing or by email.

Right to erasure ("right to be forgotten")

Every data subject has the right to request the immediate deletion of personal data concerning them if one of the following reasons applies and further processing is not required:

  • the personal data is no longer necessary for the purposes for which it was collected or otherwise processed

  • the data subject withdraws the consent on which the processing is based, and no other legal basis exists

  • the data subject objects to the processing, and there are no overriding legitimate grounds for continuing the processing

  • the personal data has been processed unlawfully

  • the deletion is required to comply with a legal obligation to which the controller is subject

  • the personal data was collected in relation to information society services offered directly to a child.

If one of the above conditions applies and you wish to have your personal data deleted, you may contact the responsible office named in this privacy policy at any time, either in writing or by email.
If your request is approved, we will delete the relevant data without delay, provided that no legal retention obligations or other legal grounds prevent its deletion.

Right to restriction of processing
Every data subject has the right to request that the controller of this website restrict the processing of their personal data if they contest its accuracy, if the processing is unlawful, if the data is no longer needed but is required for the establishment, exercise, or defense of legal claims, or if they have objected to the processing.
If processing is restricted, the affected data may, aside from being stored, only be processed with your consent, for the establishment, exercise, or defense of legal claims, to protect the rights of another person, or for reasons of important public interest. If you wish to exercise your right to restrict processing, you may contact the responsible office named in this privacy policy at any time, either in writing or by email. We will implement the restriction without delay.

Right to data portability
Every data subject has the right to receive the personal data they have provided to us in a structured, commonly used, and machine-readable format, or to request its transfer to another controller, where technically feasible. Once an objection has been submitted, your personal data will no longer be processed unless there are compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing is required for the establishment, exercise, or defense of legal claims.
You also have the right to object at any time to the processing of your personal data for direct marketing purposes. This includes any profiling related to such marketing activities.
If you wish to exercise your right to object, you may contact the responsible office named in this privacy policy at any time, either in writing or by email.

7.     Collection and Processing of Personal Data
The data that you provide to us

We collect and process personal data when you voluntarily provide it to us in the course of contacting or communicating with us, for example, by email, telephone, or via a contact form on our website.
The personal data we request typically includes your contact details (such as name, address, telephone number, and email address), the content of your message, and the date and time of your inquiry. If we need to process special categories of personal data, we will obtain your explicit consent in advance and inform you of the purpose of such processing.

The purpose of data processing is determined by the context of your contact. We generally use your data to:

  • to respond to your inquiry or provide feedback,

  • to maintain an existing or potential business relationship,

  • to ensure effective customer service, or

  • to process business inquiries and communications.

We do not use your personal data for any purposes other than those originally intended, nor for purposes that are incompatible with them. Under no circumstances will your data be sold or passed on to third parties for unrelated reasons.

If we receive personal data about you from third parties (such as business partners or service providers), we will inform you in accordance with legal requirements and, where necessary, obtain your consent before processing it.

If we receive personal data that we did not request and that is not required for providing our services or receiving services from you, we will delete or anonymize this information, unless we are legally obligated to retain it.

Data sources and data categories

We primarily process personal data that you provide to us directly or that we collect in the course of operating our website.
In certain cases, we may also receive personal data about you from third parties.
This may include the following categories of personal data:

  • Personal master data (e.g., name, address, date of birth)

  • Contact details (e.g., telephone number, email address)

  • Financial information (e.g., account details)

  • Online identifiers (e.g., cookie ID, IP address)

This data may originate from:

  • public registers (e.g., commercial register, debt collection register, land register),

  • publicly accessible sources (e.g., internet, media),

  • administrative or court proceedings,

  • professional networks or business correspondence,

  • credit reports or information from third parties for contract processing.

  • data generated through the use of our website

Automatically collected data

When you visit our website, your browser automatically transmits certain data to our server. This information is required for the technical operation of the website and to ensure its security, stability, and proper functionality. The following data is collected: the IP address of the requesting device, date and time of access, name of the internet service provider, browser type and version, operating system used, and the referrer URL (the previously visited page).
This information is stored in so-called server log files.

The data is collected in anonymous form and used exclusively for technical and security-related purposes—for example, to ensure a smooth connection, maintain system stability and security, and optimize the technical performance of our website. No personal analysis of this data takes place, and it is stored only for as long as necessary to fulfill these purposes.

Log file data is automatically deleted at the end of each session.

Please note that storing log files is essential for the operation of the website. For this reason, it is not possible to object to this processing unless you refrain from using our website.

8.     Publication of Images Containing Personal Data

Photos in which individuals are identifiable may be published on our website. Such images are only published with the consent of the individuals depicted or in cases permitted by law (e.g., public events). Publication is carried out in accordance with the Swiss Data Protection Act (DPA) and the personality rights set out in Articles 28 ff. of the Swiss Civil Code.

Individuals shown in such images have the right to object to their publication at any time, unless overriding legitimate interests or legal obligations prevent removal.
Requests for the deletion or anonymization of an image may be submitted at any time, either in writing or by email, to the responsible office named in this privacy policy. We will process such requests immediately and remove or anonymize the image where required.

9.     Disclosure and Transfer of Personal Data
Please note that in certain cases the provision of personal data is required by law (for example, due to tax regulations) or may arise from contractual obligations (such as information needed to conclude or fulfill a contract). If you wish to enter into a contract with us, it may be necessary for you to provide specific personal data that we are required to process for this purpose. Without this data, we may be unable to conclude or fulfill a contract. Before you provide any personal data, we will inform you in each individual case about

  • whether the provision of such data is required by law or contract, or is necessary for entering into the contract.

  • whether you are obliged to provide the data, and

  • what the consequences would be if you choose not to do so.

Use of service providers

For certain activities, we rely on external service providers (so-called processors). These include, in particular: accounting, fiduciary, and auditing firms; consulting providers (e.g., legal or tax advisors); IT service providers (such as hosting, maintenance, cloud services, or website support); payment service providers (only with your explicit consent); and, where applicable, advertising service providers.
We ensure that these third parties comply with all applicable data protection regulations, treat your data confidentially, and process it exclusively on our behalf. Personal data is only shared with them if you have expressly consented to it or if a legal basis permits such disclosure.

Transfer of personal data abroad
In the course of certain processing activities, personal data may be transferred to companies located abroad. These companies are contractually required to ensure a level of data protection equivalent to that of Switzerland. Such transfers may occur worldwide.

If the level of data protection in the recipient country does not match Swiss standards, we conduct a risk assessment and contractually ensure that adequate protection is in place—for example, by using the EU Commission’s Standard Contractual Clauses or other legally required safeguards. If the risk assessment indicates an elevated risk, we implement additional technical measures to protect your data, such as encryption or pseudonymization. You can review the EU Commission’s Standard Contractual Clauses at the following link:
https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_en.

10.     Duration of the Storage of Personal Data

We store personal data only for as long as necessary to fulfill the purposes for which it was collected. The primary criterion for determining the storage period is the applicable statutory retention requirement. In Switzerland, contract and accounting data must be retained for 10 years in accordance with Article 958f of the Swiss Code of Obligations.

After the retention period expires, the relevant data is routinely deleted unless it is still required to fulfill or initiate a contract, or to protect legitimate interests (such as preserving evidence or asserting or defending legal claims).

If no legal or contractual retention obligations exist, personal data is deleted as soon as it is no longer needed for the purposes described above.
